Contrary to popular belief, I am NOT MARIE F! However, confusion has set in. I've have read and posted and have even asked questions that some here took the time to answer. Thank you for that. The plot just keeps on thickening! I can't follow the storyline anymore.
So I have a question, when will the courts decide on the exumation of JK?
And when they do decide to EXUM or not to EXUM, what happens from there.
Also, how many people who are posting here could be possibly related to JK directly or indirectly.
Again, I AM NOT MARIE FERNANDEZ, AND I'M NOT RELATED TO ANYONE WHO IS OR IS NOT. I HAVE NO HISPANIC BLOOD THAT I KNOW OF IN MY FAMILY OR KENEDY FOR THAT MATTER.
Whoever runs this board can ping my IP and find that out easily. And if you do, can you please "lay to rest" the thought that some have here that I am Marie F? A simple NO she's not would be easy enough.

I have known this Element for a long time in South Texas. I was not in the least interested. My Father & Mother lived underneath Andy & Denise Turcotte when Andy was building the boat. Andy Turcotte was their landlord and friend. He spoke everyday to my father while he would soak the long peices of wood so that they would bow. My Father has been invited numerous times to Dine with The Armstrong's on their Chicago Ranch as Johnny referred to it. Tobin Armstrong would always say Come on down and we'll fill up your feed sack". He was a good man and probably seen nothing wrong with his ways as he was blinded to them. I am so disgusted because I have to write this stupid book about this whore from HELL! I wasted the past eight months of my life researching and investigating any and all information that pertained to the current Texas Supreme Court case pending in the most corporate loving court of judges you'd love to call your “friends”. I was appealing a conviction that the latest opinion self explains the jist of my battle since fall of 1999. When I discovered El Defenzor message board; that, I believed was a GODsend; at the time when I really needed a miracle. Well, I and Jaime were advocating the David’s while fighting the plethora of Goliaths, which ironically.... turns out to be the ones we helped as our Collateral Attack forced the goliaths to unite. I posted a message on the kenedyranch.net message board that basically stated that at the very least, if in fact Mr. Fernandez’s mother was a biological offspring of John G. Kenedy, Jr. she was entitled to back child support that legally would have been court ordered in this current legal climate. When we met her at “On the Border” the president of “CULLEN / FROST BANK” Mike Carrell showed up after we were seated. Marie was already talking about the Banks and I asked her if she knew who he was when he appeared. I knew who he was! I am an avid reader of our local papers society pages which he and his are a regular. Marie did not believe me, when I informed her who he was. So I said “I will introduce you to him” cuz I knew it was him. I walked up to him after we came out of the bathroom “Mr Carrell, may I introduce Mrs. Marie Fernandez! The Perfect gentleman, immediately, he stood as did the two other gentlemen at the table. Greetings were exchanged as JJ Gotchow (of Whataburger Field) and another whose name I cannot recall! Mr Carrell asked my name and I told them we were just wanting to introduce ourselves since we intended to be a presence in their immediate future. I should have known when I got so sick after that she was no good! It was never only Marie. Always Ray would discuss everything we were doing and give me suggestions or tips. We (me & my wife) spent many hours and many days almost daily for the first 6 months after the OUCH. Maybe they could use the postings against me?? Maybe I can use them for South Texas? I am sure they will use everything they can against me. It was never just Marie we were always checking with Ray about this or that. But we watched it (Marie the Buffer) be that way with many. I can tell you story after story. Ray did not know South Texas. He did not know the people and circles of people. I watched out for him when nobody else would (at least publicly). He was shunned! Later on tonight I will tell you about the time when Ray joined the Rotary Club. He needed a bunch of "already members" to sign his Member Book. I can tell you of the Days we spent disecting Elena's Transcript. Maybe the two or three weeks we spent going through "THE BROTHER LEO FILES" as they called them. Truly amazing stuff. Letters from Sarita to Leo Leo to Sarita. To Peter Grace and Cardinal Krol. I can tell you how we traveled to here or there and did this or that over and over. What I tell you will be true. What Ray & Marie promised in here I still have. They made committments on this board and the same committments were made to me in person. I have emails and witnesses to back up the committments that they made. I welcome my postings being used in a court of law if that is what must happen. Truth is on my side. Myself I like to troll the mouth on both sides Point Penascal and Point of Rocks! One time a storm blew in and we had to get to the closest shore. It was at the corner of Kenedy Shores where the Bay congrues with the intercoastal. Some of the best fishing in the world. Hell we always catch em big we call em LOGS. We never weigh em just go by length! A 31 inch Flounder, 27 28 inch trout all day long. My favorite is the fight of the Redfish. The fun is catching them on 8# test. Watch em run, wear em out and reel em in! Now, that is what I am talkin bout Baffin Bay!

about the Amicus Curiae I will be presenting to the Justices in Austin.

I am arguing for Fernandez Lineage as well as the other heirs and relatives of blood relation who were squeezed out.

It is much more than that but I will let it surface through the JUSTICE system in Austin.

It will be productive for all known & unknown relations.

Even if they have previously settled.

This will bring much more power and a much louder voice to the "Fernandez Cause"!

It names relatives living and deceased who are entitled to consideration regarding lineage primarily.

I’m not going to mention his name, even though it’s been all over the media. His rights have been violated enough. So has his person, physically, violently, by the high school he attends, by the sheriff’s deputy called to subdue him, and subsequently by the sheriff himself and the school district, who alternately rationalized, justified, excused and in some measures applauded what they should have condemned outright as a barbaric act: The willful electrocution by Taser of a 16-year-old boy, a special education student with emotional or behavioral problems, in his classroom, for refusing to do his work. They’ll tell you that he hit a deputy. He did. But only in reaction to the deputy’s attempt to wrestle the boy off his seat and forcibly remove him from his classroom, simply because the student refused to follow directions. The whole thing unfolded in a matter of minutes, not hours: the school wanted to keep its schedule. By morning’s end a 16-year-old had been booked at the county jail on a felony charge, then shipped off to a juvenile “detention” facility one county over. And the deputy typed “case closed” at the end of his incident report. This is the country we’re living in, the police agencies we have to live with, and the school systems that enable them. This is the county I’m living in: this happened in my school district, in Flagler County, last Thursday, at Flagler Palm Coast High School, the school where my daughter would be attending in a couple of years, although I hear the former sheriff, speaking to the school board today, told the five men and women that “if this board doesn’t take a stand you’ll never get a chance to educate my 10-year-old child.” Our daughter is being home-schooled in preparation for ninth grade there. But those words sound right to me.

This, then, is what happened, based on what school district personnel said, what the sheriff said, and what the sheriff’s incident report says. The student was in Robert Ripley’s classroom. He was refusing to complete an assignment. He was being “disruptive.” He was not being violent: he was not physically hurting anyone or anything. He was acting out. Nothing extraordinary there, in the sense that disruptions like that occur, even with “regular” students, and are expected to occur with special ed students. Paul Peacock, a vice-principal, and another individual whose name was misspelled on the incident report were in Robert Ripley’s classroom when the “school resource deputy,” Scott Vedder, arrived. (For those of you reading this in more civilized places, like New Jersey, cops are routinely assigned to permanent security detail in schools here, even in elementary schools, and euphemistically referred to as “school resource officers” or “school resource deputies.” An uncle of mine from Princeton, N.J., who happened to be visiting here the evening after the incident at the high school, was describing to me a school in Jersey that was testing the law by attempting to forbid cops from entering school grounds even if going after a student suspect; the school was arguing that a school should be a sanctuary. Interesting idea. Heretical, in a semi-police state like Florida . Likely laughable, in a county like mine.)

Let Vedder’s account in his incident report pick up the story at this point; the timeline picks up just before Vedder arrives, based on what the adults in the room told Vedder:

When [the student] was approached by his teacher R. Ripley, he became very belligerent and refused to participate. [The student] advised R. Ripley that he was not going to do the assignment and pushed all of his books onto the floor and threw his pencil across the room. At that time R. Ripley asked [the student] to leave the room with him. [The student] refused and said “fuck you.” At that time Mr. Peacock walked into the class room [sic.]. Upon Mr. Peacock being advised of the situation he had the other students relocate to the class room next door and asked for my assistance via school radio. While I was responding to the class room Mark Montieth arrived and he and Mr. Peacock continued to coax [the student] to leave the class room. [The student] refused to get out of his chair and go to the dean’s office. I then attempted to talk with [the student]. I attempted to talk [the student] into leaving the class room peacefully. I advised him that we needed to go to Mr. Peacock’s office and talk before the situation gets worse than it needs to be.

The emphasis is mine: not only has the deputy already escalated the situation by his presence; he is dropping threats of how much further the situation will escalate. There’s pre-meditation in crime. There’s also such a thing as pre-meditated provocation, a police skill. You see it in action here: the student wasn’t worsening the situation with his obstinacy. The deputy was worsening it by forcing the issue. He had the student psychologically cornered and surrounded. Now he was moving in, making the situation worse than it needed to be. The incident report again:

[The student] then advised that he was not getting up and nobody was going to get him out of the chair or the class room, Because [sic.] he did not want to go. I then advised [the student] that he did not havwe a choice in the matter, because he was under arrest for disruption of a school function.

The emphasis is again mine. There’s a new one on me. You can get arrested for not doing your work. For not following a teacher’s directions. For not going to “the office.” It’s a wonder I didn’t spend my entire elementary and middle school career in prison. Then again I was attending school in a more civilized place than this (by which I mean, of course, Lebanon, where Jesuits had a more effective weapon than Tasers and guns put together. It’s called persuasion and patience, a deadly combination if you’re an obstinate student like me. Jesuits generally had intelligence on their side, too.) What Deputy Scott Vedder promised, he fulfilled. It got worse:

At that time I attempted to physically remove him from the desk with an escort technique of the right arm. [The student] immediately pulled his arm away and tensed up the muscles in his upper body resisting my attempt to remove him from the chair. I advised him that if he did not comply I would deploy my Taser.

An extremely important detail here: the deputy made his first threat of using the Taser before the student had acted violently. The school board and I suspect the majority of the public would—because of the way the sheriff’s office conveyed the story—subsequently be under the impression that the Taser was used because the student struck the deputy. Not so. The deputy was ready to use the Taser whether or not the student was going to lift a hand to him, and makes that clear in the record.

He again pulled his arm away from me, looked directly at me and pulled his drew his [sic.] left hand back. [The student] then struck me in the left check with the palm of his left hand as I attempted to move out of his reach.

At the school board meeting on Tuesday, the deputy’s supervisor, Zane Kelly, exaggerated the situation just as he had exaggerated it when describing it to the press by saying that the student “struck my deputy with a closed fist.” The incident report is clear: the deputy was struck “with the palm of [the student’s] left hand.” So it goes: not only do the authorities — school and police — needlessly escalate a situation, but the perceived gravity of the incident is needlessly escalated as it is subsequently described, and in a way that unequivocally demarcates victim from officer: the victim is a demon out of control; the officer is a hero who had no choice, and followed all protocols. They call these here, proudly, “the matrix of force.” Here it is in action:

At that time I disengaged from [the student] and drew my M26 Taser emitting the laser aiming function onto his chest and advised him several times to get down on the ground or I would deploy the Taser [sic.] [The student] refused to comply so I then deployed the Taser by pulling the trigger one time for a five second cycle. [That’s 50,000 volts for five seconds, pronged into the student’s skin.] [The student] then rolled off of the chair onto the ground. [The student] then complied with all of my commands and I was able to secure him without further incident.

If irony could speak. A important bit of history: Two years ago when the new sheriff was elected (Don Fleming who, incidentally, had been a police chief in a New Jersey Meadowlands town much like the one portrayed in “Copland”) he immediately talked about arming his school cops with Tasers. The school board discussed it and rejected the idea. The sheriff said he’d comply. He was even quoted to that effect in the papers. Obviously, he didn’t. The school board met on Tuesday. The sense before the meeting was that a clear policy would be drawn up banning Tasers from schools. Not so fast. The board prevaricated. The board attorney advised against a policy, otherwise the school board would be liable should a student be hurt in an incident where, say, a gun was used where a Taser might have done better. So goes the twisted logic of agencies more fearful of lawsuits than protective of their students. No one seemingly condemned the use of the Taser outright. No one seemed, as they should have been, outraged. Doubt was getting more than its benefit. It was sprinkling the whitewash. So the best they could settle on was a workshop to discuss the matter further. Zane Kelly, the school cops’ supervisor, even used the word “proud” when describing his deputy’s reaction after the deputy was allegedly “struck.” Because, Kelly said, the deputy backed up, composed himself, and ordered the student to comply.

Then he fired.

And we wonder why we’re living in such violent times. And we wonder why, when stories like this make it into the press, the reaction by the general public is revoltingly approving of the use of force under those false rationales that even the local superintendent and cops are quick to use: better a Taser than a gun. As if those were the only two options. As if we have become so barbaric in our algorithms of law and order that the only two variables in the formula have to be force and order. And all this because a 16-year-old boy, a special education student, was acting out. It reminds me of another recent incident in the Daytona Beach area a couple of weeks back that began with a speeding car, was followed by a high-speed chase, and ended with thirty cops’ bullets fired at the car. The two occupants somehow survived, though they were wounded. And the cops didn’t even know if the person on the passenger side was a kidnapping victim or worse. But they fired. What triggered the folly it in the student’s case, and who’s at fault for letting the student escalate to the point where a cop was in the classroom instead of a trained counselor, a conflict-resolution specialist, even a couple of medics for that matter? (The medics turned up later, post-zapping.)

The Palm Coast high school student is 275 pounds and 6 or 6-1. His size is used repeatedly as further justification that he could have been trouble. The more reason to invoke conflict-resolution techniques. His size, his age, his status as a special education student are all irrelevant in the end: Tasering a student in his school, in his classroom, a student who was causing no worse harm than upsetting, loudly and maybe aggravatingly, a day’s routine, is a greater crime than anything the student could have been doing.

A couple of other details about the incident. The student is black. To my knowledge, every individual involved in his disciplining and cornering was white, even though the school has a black dean and a black assistant principal. Maybe color is irrelevant in this case. Maybe it isn’t. It certainly shouldn’t be ignored. Neither should this: The student’s father died a violent death some years ago. And Tuesday, while the school board discussed his case in a cakewalk of prevarications, the student turned 17. Happy birthday. Oh, and this week is “Disability Awareness Week” at Flagler Palm Coast High School, “in order to create more compassion for those with disabilities.” Great job.

Collusion is an agreement, usually secretive, which occurs between two or more persons to deceive, mislead, or defraud others of their legal rights, or to obtain an objective forbidden by law typically involving fraud or gaining an unfair advantage. It can involve "wage fixing, kickbacks, or misrepresenting the independence of the relationship between the colluding parties."^[1] All acts affected by collusion are considered void.^[2]

In the study of economics and market competition, collusion takes place within an industry when rival companies cooperate for their mutual benefit. Collusion most often takes place within the market form of oligopoly, where the decision of a few firms to collude can significantly impact the market as a whole. Cartels are a special case of explicit collusion. Collusion which is not overt, on the other hand, is known as tacit collusion.

According to neoclassical price-determination theory and game theory, the independence of suppliers forces prices to their minimum, increasing efficiency and decreasing the price determining ability of each individual firm. However, if firms collude to increase prices loss of sales is minimized as consumers lack alternative choices at lower prices. This benefits the colluding firms at the cost of efficiency to society.

One variation of this traditional theory is the theory of kinked demand. Firms face a kinked demand curve if, when one firm decreases its price, other firms will follow suit in order to maintain sales, and when one firm increases its price, its rivals are unlikely to follow, as they would lose the sales' gains that they would otherwise get by holding prices at the previous level. Kinked demand potentially fosters supra-competitive prices because any one firm would receive a reduced benefit from cutting price, as opposed to the benefits accruing under neoclassical theory and certain game theoretic models such as Bertrand competition.

Collusion is largely illegal in the United States, Canada and most of the EU due to antitrust law, but implicit collusion in the form of price leadership and tacit understandings still takes place. Several examples of collusion in the United States include:

Andrew Malyi and market division among manufacturers of heavy electrical equipment in the 1960s.
An attempt by Major League Baseball owners to restrict players' salaries in the mid-1980s.
Price fixing within food manufacturers providing cafeteria food to schools and the military in 1993.
Market division and output determination of livestock feed additive by companies in the US, Japan and South Korea in 1996.

There are many ways that implicit collusion tends to develop:

The practice of stock analyst conference calls and meetings of industry participants almost necessarily results in tremendous amounts of strategic and price transparency. This allows each firm to see how and why every other firm is pricing their products.
If the practice of the industry causes more complicated pricing, which is hard for the consumer to understand (such as risk-based pricing, hidden taxes and fees in the wireless industry, negotiable pricing), this can cause competition based on price to be meaningless (because it would be too complicated to explain to the customer in a short advertisement). This causes industries to have essentially the same prices and compete on advertising and image, something theoretically as damaging to consumers as normal price fixing.

There are significant barriers to collusion. These include:

The number of firms: As the number of firms in an industry increases, it is more difficult to successfully organize, collude and communicate.
Cost and demand differences between firms: If costs vary significantly between firms, it may be impossible to establish a price at which to fix output.
Cheating: There is considerable incentive to cheat on collusion agreements; although lowering prices might trigger price wars, in the short term the defecting firm may gain considerably.
Potential entry: New firms may enter the industry, establishing a new baseline price and eliminating collusion (though anti-dumping laws and tariffs can prevent foreign companies entering the market).
Economic recession: An increase in average total cost or a decrease in revenue provides incentive to compete with rival firms in order to secure a larger market share and increased demand.

A local attorney has announced he is running for chairman of the Nueces County Democratic Party.

There has been talk that several people might run. On Monday, attorney Robert Zamora officially announced that he has filed for the position, which is now held by Alex Garcia Jr.

"I have not only experience as a lawyer operating my own business for close to 30 years," Zamora said. "What I would like to do is lend the energy and the experience that I have to the operation of the Democratic Party here in Nueces County.

The race will be decided in the state presidential primary in March.

What a superficial column! This is never about anything substantive- never discusses any real political issues. This lady is just a groupie at council and commissioner's meetings, reporting the stupid things they do or say.

The last week of the year is when people are making their final decisions to run for office. Something could have been written about attorneys thinking of challenging the rude Judge Longoria or what happened about possible opponents to Juan Garcia but no she'd rather talk about nonsense. If she wants to learn more about what commissioners are thinking when they dress the same perhaps she can do a series hiding out in each politician's closet and watching and listening to them dress- and the Caller - Times can get someone to deal with the more serious issues.

This morning I got a call that took me out on the streets. I hear the end of a discussion with our Corpus Christi City Council Member stuck smack dab in the middle of that damn river.

Some begin to ponder, while there are others who know exactly where I am going with this River issue; after we finish with (this issue), Mr Mike Hummel will always remember to read the local internet and to give credit where credit is due.

You know with the Memorial Coliseum I have not the sentimentality or passion like many of you guys possess and concurrently I dont believe it needs to be torn down. I was against anything that TRT wanted to bring to this town in light of what they left us upon departure.

Some events and it might even be many events; cannot afford to use ABC Center; so it is not really a public arena like the Memorial Coliseum operated. Heck, many of us cannot afford to attend an event that is held in the ABC Center. So, tell us Mr. Hummel, Mr Burns and Mr Solis, will you make it affordable at least for our Local Goodwill Organizations like the Shriners to hold an event?

Currently, the ABC Center is out of our Local Goodwill Organizations reach because of price?

The discussion was about the Memorial Coliseum and specifically about the hiring of a consultant and if the City of Corpus Christi is going to follow WATT ever the Consultant recommended.

Corpus Christi City Councilman Hummel answered that the people have been included in the rounds of community input and public meetings.

The host asked if the Corpus Christi City Council was going to ask the consultant to include the input or if it will factor in.

Corpus Christi City Councilman Hummel quickly affirmed that the community's input has already been included.

The host then connected like Barry Bonds, Hank Aaron and the Great Bambino Himself; he asked Hummel if the Corpus Christi City Council is considering the input from all of the people at the Caller Times on the Coliseum issue?

Mike Hummel answers "I don't know anything about whats going on at the Caller Times".

The host says you dont know, you haven't read the article at the Caller Times about the Memorial Coliseum and the internet input and suggestions from the public, you arent going to consider that input?

Hummel studdered 3 or 4 times and then a couple more times and then he said we got, we got people, we got other people on that, I think, I'm not a computer guy , but I think they are calling them something like blogs, Im not a computer guy, or something like that. Then continued the D NILE of the POWER OF THE INTERNET and the reality that the People are beginning to Engage themselves in the Formulation of Public Policy. You plan a vacation and plot out your trip planning to stop for the young ones at the rest areas and to stretch the legs and maybe even swap drivers. Everybody has their pillow and their reading material or headphones and music, for the kids you had the video screen and dvd systenm installed and you even went the extra mile and installed a Playstation III for the kids and the kids at heart.

So we are cruising and everyone is commenting on the comfort, the neat features, the enhanced entertainment, and the overall "On The Road" experience the new vehicle provides.

The last thing on their mind is breaking down, needing to check the fluids every few miles, or rolling down the window because the air conditioning dont work. The passengers and the driver feel secure and safe; maybe they dont even buckle up.

The next thing we know the vehicle has become impaired and unstable. The resulting tumbling, sliding, shattering of glass, screaming, and bending of metal that happens in less than a minute (but feels like a lifetime) comes to a rest and there is a eerie silence for a moment. Then the lucky ones can moan in their pain and the silent ones Vaya Con DIOS. How long before the Halo FLight? How long before rescue?

And you come to find out you have lost 1 or 2 or 5 of your loved ones because of something that makes no sense at all.

I am not talking about the Blowout people, I am talking about the decision made by the automaker that your loved ones were just another number, a casualty in the name of profits.

Three college girls are driving cross-country pulling a U-Haul trailer while simultaneously sharing a bag of marijuana. About 20 hours into the voyage, the driver brakes hard on a hill and loses control, sending the car off the side of the road.

They weren't wearing seat belts.

Was she high? Fatigued? Did she forget that breaking hard on a downslope while pulling a fully-stuffed U-Haul is a big no-no?

Whatever. Represented by Corpus Christi plaintiff's lawyer Mikal Watts in a suburban Houston courtroom, she demanded millions in damages over the accident-- from a tire maker.

No matter that Texas state investigators blamed the wreck on driver error and speeding, concluding the tires remained intact after the crash and worked just fine. Still, Watts argued they were wrong, that it wasn't her fault. He even demanded the judge declare a mistrial when the defense had the nerve to raise the girl's driving-while-pot smoking in court.

Is this the kind of guy-- one who would make such a specious, if self-serving, argument with a straight face-- that we want representing Texas in the U.S. Senate?

Mr. Watts, a 39-year-old mega-millionaire and judge's son who flies private, is traveling the state this summer, raising money and straining to re-define himself as a populist "everyman" in preparation for the Spring 2008 Democrat primary election.

He made his bones making arguments like the aforementioned, suing automakers and other businesses. But suffice to say, he won't be bragging on the campaign trail about the "marijuana mistrial" or his lawsuit blaming Ford for an accident in which the driver was speeding, had been drinking and wasn't wearing a seat belt.

The automaker was at fault because, according to Watts, it didn't laminate its side windows.

Watts will also remain mum about the embarrassing hiccup in that Ford case-- when it was revealed mid-trial that one of his associate lawyers was dating one of the jurors. She had even helped him "recruit" two of the plaintiffs for Watts, evidence showed.

Apparently under no ethical obligation to tell the court about this, Watts remained quiet and steadfast. It paid off-- he won a $31 million verdict.

"Mikal Watts has spent his entire career fighting on behalf of average, working Texans," promised his spokesman in a recent interview.

Don't believe it just because he says so.

I was a candidate for the Del Mar Board of Regents. I picked up the package to run for office. I am College Educated. I have several degrees. I'm pretty good at reading and writing contracts and such. I'm not a lawyer and believe me I could have used a lawyer to explain all the stuff I was responsible for and had to do. Del Mar wasn't going to explain it to me and the local party bosses wouldn’t have anything to do with me. Del Mar certainly wasn't going to help Linda whose brother they had railroaded out of a job. Now Linda was the first person in a Corpus Christi Public Housing development to successfully run for a public office and her neighbors were very proud of her. What do we want?

Go do some homework, we want responsive representation with transparent operation.

We want to not be railroaded for tardies or for absences when the District does not practice due diligence in interdicting but is very diligent in recording the events and adamantly prosecutes and collects half of the fine. When the people cant pay the kids are picked up from class and taken in handcuffs to the court of nonrecord. The Parent is contacted and ordered to appear immediately. When the Parent arrives he or she is told to pay or your kid goes to jail and sometimes the parent is threatened and / or locked up as well. I have never seen a kid who has been provided counsel but I have witnessed many a kid go to jail.

Watts, a Democrat, who is seeking the seat held by Republican Sen. John Cornyn, asked the gathering to dig through their Rolodexes and e-mail address lists because he hopes to compile a statewide database to reach Democratic voters that can be used by all Texas Democrats.

I must say the tactics being carried out right now are transferring from a division between majority & minority groups to a division of within the minority groups. This concept is how CCISD manipulates. Think about it? Investigations, Colloquial Intelligence, Manipulation of one’s JOB opportunities, personal & political missions and nanotechnology to forecast, design and carry out plans ranging from 0 to at least a good 20 years. WIA slush fund is all about the final data in each category. There are many exemptive solutions & creative methods that are encouraged. The WIA allows the creation of multiple programs and agencies to create JOBS or JOB training. WIA is the DARE program, COPS program, Communities in Schools, and anything they can draw up a quick blueprint of. Innovation and Malleability produce stellar new programs from dedicated grant writers given the concepts and goals of a brainstorm. This is a brilliant concept for our youth. The problem is the adults take candy from the babies. CCISD is way to big for their britches. A board much too elevated to consider input from the community. CCISD: Why are CCISD Students allowed to run at large during school day hours?

Education is for our Children, our Youth, our Future. Children and Youth need constant redirection and set boundaries at home and at school as well. When a minor is allowed to run at large during the school day hours whether it is in the halls, leaving or returning a closed campus or simply unaccounted for is irresponsible of the caretaker whose custody in which he / she is placed.

An absent student is one who does not arrive at school in the morning and is absent for the WHOLE Day. The student was never on campus. The Parent is responsible for the student getting to school (requiring the student to attend school). If the student does not get to school it is the Parent’s responsibility not necessarily the Parent’s fault. There are circumstances where the student will walk in the front door and out the back door without attending a single class. This is where the attendance officers need to improve their due diligence like the old days.
Once the student is counted present in the morning; the Parent has required the student (child) to attend school. Once the student is verified in attendance at the beginning of the school day the student is in the custody of the School.
If the student is tardy or skips class (on campus or off campus) this happens on the watch of the school. The Parent if informed should cooperate and communicate with the School Counselors Administrators and the Attendance Officer to correct the behavior. The Security and Attendance officer should take notice and tighten the belt. This is a security issue as well; there is no excuse for students coming and going outside of the lunch period and it is imperative that attendance irregularities be dealt with within 24 hours. This is easily done with our modern technology.
Instead, what we are seeing is the Attendance Officers documenting the absences as they accumulate and filing on the Parent and student when the number of absences are achieved.

The process the CCISD Board used is unethical and unfair. Every single applicant took the time to fill out an application, and the thought process for the letter of interest and update of their resume and references. For all intensive purposes this CCISD Board just threw that work product into the trash can while opting for business partners, friends cronies and industry allies.

It is not about the 5 selected it is about how the 5 were selected. It is not about Barrera or Prezas or Bill Clark or Lucy Rubio.

It is about a change of policy where policy is defined by processes of the past. Lucy is the only one with the guts to make the motion, "for the board to scrap the current process and start over. One parent we spoke with Thursday said the policy didn't make sense, because while students who fail the TAKS test during the school year aren't allowed to take part in graduation ceremonies. The same doesn't hold true for summer school grads. They're allowed to participate in summer graduation ceremonies without knowing whether they passed the test.

The decision didn't sit well with some parents and students.

School board member Lucy Rubio had hoped to amend the policy, and allow seniors who failed the TAKS to at least walk in with their class during may commencement. But other school board members didn't agree.

After analyzing the recent events surrounding the resignation of CCISD Board Trustee Harry Williams (1 of 3 at large district positions); one thing IS clear. That one thing is Due Process (or lack of it). Immediately one's memory of search firm fiascos and the CCISD Board tool of choice, the Interim Superintendent buffer / scapegoat. The process was elaborate and ethical reasons or rule were claimed as the reason for the process.

Well, why such a rush fellas?

Why is the CCISD board in such a hurry to fill this position?

A Superintendent position and a Trustee position; one we wine, dine and lodge and the other we announce for applications for a month or so and "narrow the list down" from 20 to 5 in most expedient fashion. Now, making a long story short we have 20 candidates who invested their creative, intellectual and professional abilities into a work product they hope will be scrutinized by the Board and be successfully competitive. A good letter of interest comes only from the heart. The application is at times tedious but at least it is more objective than the TAKS. Updating one's resume and with a list of references most meaningful to the position and all of this for 15 to get thrown in the trash can and the 5 resumes remaining are to place on public display

This RFC is being opened in order to further a centralized discussion concerning actions to be taken against US Congressional staffers and possibly other federal employees who have engaged in unethical and possibly libelous behavior in violation of Wikipedia policies (WP:NPOV, WP:CIV). The editors from these IP ranges have been rude, abrasive, immature, and show disregard for Wikipedia policy. The editors have frequently tried to censor the history of elected officials, often replacing community articles with censored biographies despite other users' attempts to dispute these violations. They also violate Wikipedia:Verifiability, by deleting verified reports, while adding flattering things about members of Congress that are unverified.

The offending editors have been blocked. This RFC is needed to gather community comments. It is proposed that a one week block is not enough. The block was lifted January 30, 2006. A new block for additional vandalism was enforced for three hours February 1, 2006 at 14:59.

I found it a bit disconcerting that no evidence that this IP is actually from the House [had] been presented, so I dug it up. This indicates that it's registered to "Information Systems, U.S. House of Representatives" in Washington, D.C. and provides a contact of "Joseph Adams". - The 'geographic trace' is effectively meaningless. ARIN is authoritative for who the IP block has been assigned to, and ARIN's record says its assigned to the House. Ill wind divides historic ranches

SARITA — Johnny Vela, among the latest in a long line of Kenedeños who have worked for generations as coastal cowboys in South Texas, knows the friendly history of the legendary side-by-side Kenedy and King ranches.

“That’s what we’ve always thought,” said Vela, standing outside his modest home a couple of blocks from the Kenedy County courthouse.

Vela and other townsfolk also know that nearly a century and a half of peaceful coexistence has been shattered — and not because of rustling, fences or anything else that might have set neighboring ranches to battle in the Texas of yesteryear.

This modern fight is about wind-powered turbines, namely those the Kenedy’s overseers want and the King’s operators don’t. And instead of duking it out on their vast expanses of largely unspoiled range, it’s a war of words mostly waged in office buildings in Houston, San Antonio, Corpus Christi and even Portland, Ore.

“(King Ranch Chief Executive) Jack Hunt goes around telling lies and misquoting information and has no technical skill whatsoever, trying to mislead the public that wind energy doesn’t exist and doesn’t add any value, doesn’t produce much and is a tax debacle,” said John Calaway, whose company plans to build 157 turbines on a plot now owned by the John G. and Marie Stella Kenedy Memorial Foundation.

Calaway oversees the project from the 40th-floor downtown Houston branch of Babcock & Brown, an Australia-based investment firm.

The mere mention of Hunt’s name might cause smoke to come from his ears if he weren’t so opposed to carbon dioxide emissions.

‘Last great habitat’
Likewise, at the King Ranch’s 16th-floor headquarters in the Galleria area, Hunt gets agitated just thinking about 400-foot-tall turbines picketing the pristine coastal prairie of Kenedy ranch land, which is nearly surrounded by King parcels.

Hunt says Sarita Kenedy East, who until her death in 1961 was the last surviving descendant of ranch founder Mifflin Kenedy, would disapprove.

“People who knew Mrs. Kenedy said she’d be spinning in her grave if she knew these lands were being used for this purpose,” said Hunt. “I don’t think this use is consistent with what the Kenedys had in mind. This area is important environmentally — it’s been called ‘the last great habitat.’ The King Ranch family feels very strongly about stewardship.”

The other wind project is proposed by PPM Energy, which plans to have 267 turbines spinning on another section of the Kenedy Ranch owned by the John G. Kenedy Jr. Trust, which was established upon the death of his childless wife, Elena.

PPM Energy spokeswoman Jan Johnson, lacking the emotion of Calaway, calmly says her company’s project is on course for operation in 2008.

“It’s not uncommon to have a few highly vocal opponents,” said Johnson, whose firm — a subsidiary of Scottish Power — is based on the seventh floor of a Portland building.

Supporting charities
Both the foundation and the trust, while separate entities, give heavily to Catholic charities and see the projects as moneymakers for a variety of causes they support.

“We are satisfied that the proposed wind farm project helps advance Mrs. (Elena) Kenedy’s express wishes to preserve the ranch for the benefit of future generations, both in terms of ensuring continued ranching operations, as well as protecting the environmental sensitivities of the area,” according to a joint statement from the trustees, nephew Pablo Seuss and Frost Bank, which is based in a 21-story building in downtown San Antonio.

Marc Cisneros, a retired Army general who heads the Kenedy Memorial Foundation, rejects Hunt’s claim that he and the trust are willing to sacrifice the unique South Texas environment for a quick payday from wind speculators.

“We at the Kenedy Foundation do not take a back seat to the King Ranch or anyone else in concern for wildlife,” said Cisneros from his 17th-floor office in downtown Corpus Christi, adding that “what wildlife worries about is someone shooting at them,” a swipe at the King Ranch’s prominence as a hunting destination.

“We looked at (the wind proposal) very carefully. We were very cognizant of conserving wildlife. We have quantitative data that show it’s not an issue.”

That data is constantly flowing into Calaway’s offices at Continental Center. A diesel-powered radar site, which sits on the lonesome Jaboncillos Pasture somewhere between U.S. 77 and the coast, has been taking continuous sweeps of the airspace since September, tracking every bird to see if dozens of spinning rotors would pose a threat.

“We’re not seeing the ‘river of birds’ that Jack Hunt talks about,” said Calaway, who holds research predicting minimal impact to bird populations. Plus, he said, the turbines practically stop on a dime if a major influx of birds does pour into the area.

Oversight at issue
Hunt admits he doesn’t know whether the turbines will whack a single bird. His problem is that there’s no regulation of building land-mounted turbines in rural areas, so no government body will vet the project.

And Hunt won’t merely take wind operators at their word.

“We haven’t seen any of that bird data,” he said. “It’s not peer-reviewed. How can you trust it when basically it’s been done by the people they’ve hired to do it? … If I wanted to build a feedlot down there, I’d have to have all kinds of permits.”

The issue has been a struggle for bird advocates such as the Audubon Society, which also supports clean energy.

“On balance, Audubon strongly supports wind power as a clean alternative energy source that reduces the threat of global warming,” Audubon President John Flicker wrote in December, outlining the organization’s position.”Location, however, is important.”

About subsidies
Hunt also needles wind projects about federal, local and ratepayer subsidies they receive and successfully fought to prevent them from getting tax abatements in Kenedy County. In return, supporters of the wind projects note the King Ranch receives generous agriculture subsidies, which Hunt acknowledges.

“That’s irrelevant. We participate in the national farm program, and we have to be competitive,” Hunt said.

He noted that a natural gas-fired plant could be built on a smaller footprint without needing any government help.

Kenedy County Commissioner Anne Armstrong, herself a prominent area rancher, said the abatement issue is closed for now.

“As I understand it, and I’m not on the inner loop, (turbine construction) probably will go ahead anyway,” she said, explaining the projects don’t seem to need county help.

It wasn’t always like this. Florida steamboat pilots Mifflin Kenedy and Richard King migrated to Texas to work the Rio Grande and built a fortune spiriting Confederate cotton through Union blockades in the Civil War.

The empty swath of coastal land they co-owned was amicably split and fenced off in 1868, allowing both men to build their own livestock empires while bringing the world to them via roads and rails.

“They were always friends, (Kenedy) and King,” said Homero S. Vera, coordinator of the Kenedy Ranch Museum at the Kenedy Ranch headquarters in Sarita. “As a matter of fact, when King died, Mifflin was there with him at the Menger Hotel (in San Antonio).”

Ranching and more
The King Ranch remains a vital 825,000-acre cattle and horse operation on the fabled Wild Horse Desert that’s co-owned by an array of descendants with varying surnames, Hunt said.

It has diversified broadly into oil and gas, farming in Texas and Florida, hunting, ecotourism and other interests.

The Kenedy legacy holdings are more modest — if you can call 400,000 or so acres modest — but the foundation and trust distribute millions of dollars to charities across Texas each year.

But Johnny Vela didn’t have time to weigh all the talk of turbines, green energy, bird habitats and tax abatements.

He was more preoccupied with a newly headless chicken hanging by its feet from a nearby tree as it bled out prior to plucking.

The night’s supper was Vela’s main concern, not the people trying to build turbines on the range where generations of Kenedeños once rode.

“They’ve got the money. So if it’s going to get done, it’s going to get done,” he said.
